TasteTap Terms of Service
Effective Date: June 6, 2026
These Terms of Service (“Terms”) govern your access to and use of TasteTap LLC’s website, mobile applications, and related services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1. About TasteTap
TasteTap provides technology that enables customers to browse restaurant menus and place pickup orders with participating restaurants.
TasteTap facilitates order transmission, payment processing, and related platform services connecting customers with participating restaurants.
TasteTap is not a restaurant, food manufacturer, food preparer, food packager, food distributor, delivery service, or courier. Participating restaurants are independent businesses responsible for the products and services they provide.
2. Platform Availability
TasteTap strives to maintain reliable service but does not guarantee continuous, uninterrupted, secure, or error-free operation of the Platform.
The Platform may be unavailable, delayed, or impaired due to maintenance, software updates, technical failures, internet disruptions, third-party service outages, security incidents, force majeure events, or circumstances beyond TasteTap’s reasonable control.
TasteTap is not liable for interruptions, delays, downtime, service failures, or data loss resulting from such events to the fullest extent permitted by law.
3. Restaurant Responsibility
Each restaurant is solely responsible for:
- Food preparation.
- Food quality.
- Food safety.
- Ingredient accuracy.
- Allergen disclosures.
- Nutritional information.
- Menu content and pricing accuracy.
- Order acceptance or rejection.
- Order preparation.
- Pickup availability and timing.
- Compliance with applicable laws and regulations.
TasteTap does not manufacture, prepare, inspect, handle, store, transport, or deliver food.
TasteTap does not independently verify all restaurant information and makes no warranty regarding restaurant products, services, representations, menu descriptions, pricing, availability, allergens, nutritional information, modifiers, or other restaurant-provided content.
You acknowledge that restaurants may update menus, pricing, hours, availability, and item descriptions without notice.
4. Guest Checkout
The Platform currently allows you to place orders as a guest without creating an account. You agree to provide accurate, current, and complete information when placing an order, including a valid name, contact information, and payment details. You are responsible for the accuracy of the information you submit and for all orders placed using your information. You agree to notify TasteTap promptly if you believe an order was placed using your information without authorization.
5. Pricing and Taxes
Prices displayed on the Platform may differ from prices offered by restaurants through other channels.
By placing an order, you agree to pay the prices, taxes, fees, service charges, and other amounts displayed at checkout.
Prices, taxes, and fees may change from time to time and may vary based on restaurant, location, order details, or applicable law.
Unless otherwise stated, all amounts are displayed and charged in U.S. dollars.
6. Orders
Submitting an order through the Platform constitutes an offer to purchase selected items from the applicable restaurant.
Restaurants may accept, reject, modify, or cancel orders for reasons including item unavailability, operational limitations, payment issues, suspected fraud, technical errors, or other circumstances.
TasteTap does not guarantee that any order will be accepted or fulfilled.
An order is not complete until accepted by the restaurant and payment has been successfully authorized or captured.
7. Order Changes, Cancellations, and Pickup
You are responsible for reviewing your order before submitting it.
Once an order has been transmitted to a restaurant, modifications or cancellations may not be possible.
TasteTap does not guarantee that a restaurant can accommodate modification or cancellation requests after submission.
You are responsible for picking up your order at the designated location and time.
Failure to pick up an order may result in the order being treated as fulfilled to the extent permitted by law.
8. Refunds, Credits, and Chargebacks
Refund requests are evaluated on a case-by-case basis based on the facts and circumstances of the transaction, including order status, fulfillment status, restaurant reports, technical issues, fraud indicators, and applicable law.
TasteTap may issue, deny, or partially approve a refund, credit, or other remedy consistent with applicable law, payment processor requirements, platform policies, and the circumstances of the transaction.
Refunds may be returned to the original payment method or another method permitted by law.
Certain fees, taxes, service charges, or processor-related costs may be non-refundable where permitted by law.
You agree not to abuse refund, credit, or chargeback processes.
TasteTap may suspend accounts, restrict platform access, refuse future orders, or take other action if it reasonably believes a user has engaged in abuse, fraud, excessive chargebacks, or repeated unsupported claims.
TasteTap may provide transaction records, timestamps, order records, communications, device information, fraud indicators, and other relevant evidence to payment processors, financial institutions, dispute resolution providers, restaurants, law enforcement agencies, or courts in connection with payment disputes, fraud investigations, chargebacks, or legal claims.
9. Restaurant Policies
Restaurants may maintain their own policies regarding preparation timing, substitutions, cancellations, wait times, and pickup procedures.
Such policies apply in addition to these Terms provided they do not conflict with applicable law.
10. Prohibited Use
You agree not to:
- Use the Platform for unlawful purposes.
- Submit false, fraudulent, or abusive orders.
- Interfere with Platform operations.
- Attempt unauthorized access to systems, accounts, or data.
- Use bots, scrapers, or automated systems without authorization.
- Circumvent security controls.
- Misrepresent your identity or payment information.
- Abuse refunds, chargebacks, promotions, or credits.
- Violate applicable laws or third-party rights.
TasteTap may suspend, restrict, or terminate access to the Platform for violations of these Terms.
11. Intellectual Property
The Platform, including software, design, branding, text, graphics, trademarks, logos, and functionality, is owned by TasteTap or its licensors and protected by intellectual property laws.
Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works based upon the Platform.
Restaurants retain ownership of their own trademarks, names, menu content, logos, and business information.
12. User Content and Feedback
If you submit reviews, comments, suggestions, support communications, or other content, you grant TasteTap a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and otherwise utilize such content for operating, improving, and promoting the Platform.
You represent that you possess all rights necessary to submit such content.
13. Third-Party Services
The Platform may integrate with or rely upon third-party services including payment processors, communication providers, analytics providers, cloud infrastructure providers, and restaurants.
TasteTap is not responsible for third-party services outside its control.
Use of third-party services may be subject to separate terms and policies.
14. SMS and Electronic Communications
By providing a phone number or email address, you consent to receive transactional communications relating to orders, account activity, customer support, security alerts, and operational notices.
Message and data rates may apply.
Consent to receive transactional communications is not a condition of purchase.
15. Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE FULLEST EXTENT PERMITTED BY LAW, TASTETAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, TITLE, AND NON-INFRINGEMENT.
TASTETAP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TASTETAP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASTETAP’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
- THE AMOUNT PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not permit certain limitations, and portions of this section may not apply.
17. Assumption of Risk
You acknowledge that food ordering involves inherent risks including allergen exposure, ingredient substitutions, preparation errors, contamination, delays, inaccurate information, and food safety issues.
You are solely responsible for communicating allergies, dietary restrictions, and special instructions directly to the restaurant and determining whether a menu item is suitable for your needs.
18. Indemnification
You agree to defend, indemnify, and hold harmless TasteTap and its affiliates from claims, liabilities, damages, losses, costs, and expenses arising from:
- Your use of the Platform.
- Your violation of these Terms.
- Your violation of applicable law.
- Your fraud, negligence, or misconduct.
- Content you submit.
19. Governing Law
These Terms shall be governed by and construed under the laws of the State of Georgia without regard to conflict of law principles.
20. Independent Businesses
Restaurants available through the Platform are independent businesses.
Nothing in these Terms creates any partnership, joint venture, agency, employment, franchise, fiduciary, or similar relationship between TasteTap and any restaurant.
21. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.
You and TasteTap agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, your use of the Platform, any order, any refund or chargeback, or any related transaction or communication, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be resolved by binding individual arbitration rather than in court, except that either party may seek relief in small claims court if the claim qualifies.
Arbitration shall be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules then in effect, except as modified by these Terms. If AAA is unavailable or unwilling to administer the matter, the parties will select a mutually agreeable alternative arbitral forum or, if necessary, seek appointment of an arbitrator in accordance with applicable law.
The arbitration will be conducted by a single neutral arbitrator. The arbitration may be conducted by video conference, telephone, written submissions, or in person, as determined by the arbitrator or the administering forum, subject to applicable law.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the fullest extent permitted by law.
22. Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TASTETAP AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION.
The arbitrator may not consolidate the claims of more than one person or otherwise preside over any form of representative or class proceeding, except to the extent such waiver is not permitted by law.
23. Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TASTETAP WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM.
24. Arbitration Procedure
A party seeking arbitration must first provide written notice of the dispute and a short description of the claim and requested relief. The parties will attempt in good faith to resolve the dispute informally for at least 30 days before arbitration is commenced, unless a shorter period is required by law or the forum rules.
The party initiating arbitration must file a demand with the selected arbitral forum and serve the demand on the other party in accordance with the forum rules and applicable law.
The arbitrator may award any relief that would be available in court under applicable law, subject to the limitations in these Terms.
Except as otherwise required by applicable law or the forum rules, each party will bear its own attorneys’ fees and costs, and the parties will share arbitration fees and arbitrator compensation as provided by the applicable forum rules.
25. Opt-Out
You may opt out of this arbitration agreement and class action waiver within 30 days after first accepting these Terms by sending written notice to:

Your opt-out notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect the other provisions of these Terms.
26. Changes to These Terms
TasteTap may update these Terms from time to time.
Updated versions become effective when posted on the Platform with a revised Effective Date.
Continued use of the Platform constitutes acceptance of the updated Terms to the extent permitted by law.
27. Miscellaneous
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision shall not constitute a waiver.
TasteTap shall not be liable for failures or delays caused by events beyond its reasonable control, including natural disasters, severe weather, utility failures, internet outages, cyberattacks, labor disputes, governmental actions, public health emergencies, third-party service failures, or other force majeure events.
These Terms, together with the Privacy Policy and any incorporated policies, constitute the entire agreement between you and TasteTap regarding the Platform.
